Guest speakers from King & Wood Mallesons and Tiger Resources Limited will take you through the restructuring of Tiger Resources, an Australia-based mining company with two active copper extraction projects in the Democratic Republic of the Congo.  The ground-breaking restructuring, while confronting numerous challenges, saw the first ever guarantor of secured debt borrowed successfully compromise the debt and its guarantees using an Australian scheme.

You will hear from our speakers on:

  • this novel scheme which further expanded the scope of the Australian creditors’ scheme as a procedure to restructure cross-border debt;
  • the importance of this in Australia where there are no other debtor-controlled restructuring procedures like the US Chapter 11 or UK company voluntary arrangement; and
  • the challenges faced and the COVID-related post-script.

Tim Klineberg
Partner, Head of Restructuring & Insolvency, King & Wood Mallesons

Tim is one of Australia’s leading restructuring and insolvency lawyers.  He has a long track record of leading major restructuring and insolvency mandates in Australia and in the Asia-Pacific Region. Much of his work focuses on planning for and achieving strategic outcomes for clients exposed to distressed situations.

Tim has advised a number of significant Australian corporates on complex restructuring transactions and has particular experience in dealing with different types of creditors and stakeholders including banks, funds, landlords and government.

Caroline Keats
Managing Director & CEO, Tiger Resources Limited

Caroline has 20 years of corporate and commercial experience and has served in various executive roles. For nearly 15 of those years she worked in the mining industry in Australia and foreign jurisdictions for ASX and TSX listed Companies. Prior to working on the corporate side, she was with both a top-tier national law firm, as well as a boutique mining law firm.

Caroline is a seasoned business executive who brings significant corporate, commercial and operations experience to her role. In particular, her background with African mining operations, and specifically her work within the DRC, is vital as she continues to drive Tiger Resources through the restructuring process.
